By submitting this form, you confirm you have read and agree to the following:

Eligibility:

– Applicants must be Cininfo Subscribers (membership verified via ID).
– Submissions must be original and adhere to predetermined Case Study shared by Cininfo.

Intellectual Property (IP) Rights:

– ⁠IP for the 4 selected scripts that will be developed at the end of the program remains with the organisers/producers and will hold exclusive rights to evaluate, produce, reproduce, sell, distribute or market the script. You shall ensure that no intellectual property rights of any person have been infringed in relation to the submissions made by you. The Company may require you at any time to produce evidence of valid ownership of the intellectual property rights in the submissions made by you.
– ⁠The materials (study synopsis, character sketch, logline and reference scenes) submitted through the application form are solely for the purpose of selection and will not be used by Cininfo.
– No further compensation shall be paid to you for the use of the script in any manner whatsoever.
– You shall indemnify and hold harmless the Company, its directors, shareholder, officers and agents, promptly upon demand, against and in respect of any and all losses, liabilities, obligations, Damages, demands, proceedings, claims, judgements or causes of action, interest, penalties and other costs or expenses, whether or not resulting from a third party claim (including, without limitation, reasonable attorneys’ fees and expenses incurred in connection with investigating any of the foregoing) whatsoever suffered or incurred by the Indemnified Parties, as a result of, arising out of, or in relation to or otherwise arising out of and/or in connection with breach of terms and conditions provided herein, or infringement of any third party intellectual property right, or any fraud, wilful misconduct or gross negligence by you.
– The Company shall in no case be liable for any indirect, special, consequential or exemplary losses or any loss of business or profits.

Confidentiality:

– You hereby acknowledge and agree that all scripts and content may be shared by the Company with third parties without your prior consent.

Code of Conduct:

– Participants must adhere to professional standards during the program.
– Misconduct, plagiarism, or breach of the code will result in disqualification.

Participation Rights and Obligations:

– Participants must commit to the workshop’s timelines and attend all scheduled sessions (online and offline).
– Cininfo will not be liable for participants failing to meet deadlines.

No Liability for Outcomes:

– Cininfo acts as a facilitator only and does not guarantee the production or success of submitted scripts.

Dispute Resolution:

Governing Law:

– This Agreement and any of your usage of this platform and your dealings with Company shall be governed and construed in accordance with the laws of India and will be subject to the jurisdiction of the courts in Mumbai.

Arbitration:
– If any dispute arises between you and the Company during your use of this platform or your dealing with the Company in relation to any activity on this platform, in connection with the validity, interpretation, implementation or alleged breach of any provision of the Terms and all the rules and policies contained herein, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by the Company. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language. The place of arbitration shall be Mumbai.

Termination Clause:

– Cininfo reserves the right to remove a participant for misconduct or non-compliance with terms. We reserve the right to delete, restrict, suspend or terminate you at any time for any reason whatsoever. We will not be liable for any loss of data or damage caused by any unauthorized use of your account.

Additions:

General:
– None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and the Company and you shall have no authority to bind us in any manner whatsoever nor shall we have any authority to bind you in any manner whatsoever.
– All the Services provided by us shall be as independent contractor and on a principal-to-principal basis. Further, we reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Limitation of Liability:

– In no event shall the Company or its affiliates and sub-contractors be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to, damages for loss of profits, revenue, goodwill, use, data or other intangible losses whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service, or for any other claim related in any way to your use of the service, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

In addition to any limitation of liability and various disclaimers provided elsewhere in these Terms, Company’s entire liability and your sole and exclusive remedy in any circumstance is limited to the aggregate fees paid by the user/customer, preceding the event of default.
